I accept complete responsibility for my child's health and well-being in this voluntary dance program/lesson. I indemnify and hold harmless Cynthia King Dance Studio Inc. (CKDS), and its directors, instructors, staff, and volunteers from claims, lawsuits, or any other action or proceeding, which results or is caused by my child's participation. This includes any attorney's fees or costs in defending any action. I agree to abide by all rules and policies established by the school for the health, safety, and well being of all participants. For the safety and general welfare of all participants, the dance studio reserves the unrestricted right to dismiss a student whose conduct or influence, in the opinion of the director, is contrary to the best interest of the studio. I hereby grant to Cynthia King Dance Studio Inc. The irrevocable and unrestricted right to use and publish photographs or video footage of my child for editorial, trade, or advertising in any medium without restriction. I hereby release Cynthia King Dance Studio Inc. And their legal representatives and assigns from all claims and liability relating to said photographs or video footage. I am aware that all payments for dance lessons are non-refundable or transferable. No reduction or allowance will be made for late arrival, early withdrawal, or time missed due to incidental absences including but not limited to illness.

I understand if I do not opt in for text messages, I/my child may miss out on important notices. I understand and agree that the primary form of communication used by Cynthia King Dance Studio are text messages and email; therefore, I agree to ensure that Cynthia King Dance Studio has my updated phone number and email information. I hereby grant to Cynthia King Dance Studio, Inc. the irrevocable and unrestricted right to use and publish photographs or video of my child for editorial, trade, or advertising in any medium without restriction. I hereby release Cynthia King Dance Studio Inc. and their legal representatives and assigns from all claims and liability relating to said photographs or video. I will not photograph or record video of any live or virtual Cynthia King Dance Studio performance, class, or event without the permission of the studio director.

I am aware that all payments for dance lessons are non-refundable or transferable. No reduction or allowance will be made for late arrival, early withdrawal, or time missed due to incidental absences including but not limited to illness. If I need to cancel or reschedule my dancer’s private/semi-private lesson I will give 1 week notice.

Dance studio rules are for the benefit of all students. Cynthia King Dance Studio rules apply for both live and virtual classes. We follow social distancing guidelines advised by all levels of government and health agencies. IN STUDIO RULES: • Temperature must be checked on entry • Anyone entering the building must wear a mask • All posted rules and social distancing markers must be followed • Students must arrive prepared for class in proper dress code (our dressing rooms will be closed) • No gum, food, or drinks (other than water) permitted in the studio or waiting area without permission • Our lobby will be closed; Please follow communication regarding pick up and drop off directions My child and I agree to abide by all rules and policies established by Cynthia King Dance Studio for the health, safety, and well-being of all participants. I have reviewed the Rules and Policies (above). I understand that the dance studio reserves the unrestricted right to dismiss a student/family from the school, a class, or a performance if, in the opinion of the director, the student's/family's conduct or influence is contrary to the best interest of the studio.

The novel coronavirus, known as COVID-19 has been declared a worldwide pandemic by the World Health Organization. COVID-19 has proven to be very contagious and is believed to be spread in many instances by “person to person” contact. In response to COVID-19 and in order to help slow down the spread of COVID-19, all levels of government and health agencies have recommended a number of measures, including, for example, social distancing and restrictions against congregating in large groups of people. I agree, represent and warrant that neither I nor any minor child(ren) (cumulatively, “I” or “Me”) that I may bring to the premises of Cynthia King Dance Studio (“CKDS”): (i) are experiencing symptoms of COVID-19, including without limitation, fever, cough or shortness of breath; or (ii) have a suspected or diagnosed/confirmed case of COVID-19; and that in the case of (i) or (ii) above, I agree that I will not visit or utilize the facilities, services, activities, classes and programs of CKDS until such time as I have been cleared to return by a duly licensed medical professional. I agree to notify CKDS immediately if I believe that any of the above access/use restrictions apply to Me. CKDS agrees that it will keep confidential, my identity, as well as any other personal information, in the event that I notify CKDS that an access/use restriction applies to Me. CKDS has taken certain steps to implement recommended guidance and protocols issued by various public health agencies for slowing the transmission of COVID-19. However, I understand and agree that CKDS cannot guarantee (and does not guarantee) that I will not contract or become infected with COVID-19 while I am present at or are utilizing any of the CKDS Facilities. Further, because CKDS will be open for use by other individuals, I recognize that visiting the CKDS Facilities could increase the risk of My contracting COVID-19. I hereby agree, represent and warrant that I will comply with any and all of CKDS rules, instructions, guidelines, procedures, signage or restrictions. I further acknowledge and agree that CKDS may revise its rules, instructions, guidelines, procedures, signage or restrictions at any time based upon updated recommended guidance and protocols issued by public health agencies, and I agree, represent and warrant that I will comply with any updated or revised rules, instructions, guidelines, procedures, signage or restrictions that may be implemented or enacted by CKDS. By signing this Agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume all of the risks and accept sole responsibility for the fact that I may be exposed to or infected by COVID-19 by visiting or accessing CKDS Facilities, despite CKDS reasonable efforts to mitigate such dangers, and that such exposure or infection may result in quarantine requirements, personal injury, illness, serious illness, disability and/or death, either to Me. I also understand and acknowledge that it may not be possible to maintain social distancing of at least six (6) feet, at all times, among children and their caregivers at CKDS. With full awareness and appreciation of the various risks involved, I, for myself, and on behalf of my family, spouse, estate, heirs executors, administrators, assigns, and personal representatives, hereby forever release, waive, discharge and covenant not to sue CKDS, and their respective owners, members, shareholders, officers, directors, agents, attorneys, servants, independent contractors, affiliates, employees, successors and assigns (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by Me related to COVID-19 whether caused by the actions, omissions or negligence of the Released Parties, any third-party visiting the CKDS Facilities, or otherwise, while participating in any activity while in, on or around the CKDS Facilities and/or while using any of the CKDS Facilities, equipment or materials, whether a COVID-19 infection occurs before, during or after participation in any activity at CKDS. I agree to indemnify, defend and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses and/or liabilities (including attorneys’ fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to my use of the CKDS, equipment, or materials, whether caused by the negligence of the Released Parties or otherwise specifically related to COVID-19. By signing below, I acknowledge and represent that I have read the foregoing Waiver of Liability, understand it and sign it voluntarily as my own free act and deed, including without limitation the Release of Liability and Indemnification requirements contained in this Waiver of Liability; I am sufficiently informed about the risks involved in using the CKDS to decide whether to sign this document; no oral representations, statements or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this document for full, adequate and complete consideration fully intending to be bound by the same. I agree that this waiver of Liability shall be governed by and construed in accordance with New York law, and that if any of the provisions hereof are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Waiver of Liability as a whole.
